Terms of Service

Terms governing use of the Surfaced website, prelaunch scanner preview, content, and future AI-visibility services.

Effective date: July 26, 2026

These Terms of Service (“Terms”) are an agreement between you and the operator of Surfaced under the SkuWatch brand (“Surfaced,” “SkuWatch,” “we,” “us,” or “our”). They govern access to surfaced.skuwatch.app, our content, previews, reports, software, and any related services that link to these Terms (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you use the Services for a business, you represent that you can bind that business.

1. Prelaunch and beta status

Surfaced is currently in development. Previews, example scores, roadmaps, and descriptions of planned features are provided for evaluation and may change or never become generally available. A preview is not a live scan unless the page expressly says otherwise. We may add, remove, suspend, or modify beta functionality at any time.

2. AI visibility and ranking disclaimer

The Services may identify technical, content, structured-data, crawler-access, and retrieval signals that a merchant can improve. Addressing those signals may increase the likelihood that a store or product is retrieved, cited, surfaced, or recommended by third-party search or AI systems. Results still depend on systems we do not control, including model behavior, indexes, prompts, location, personalization, platform policies, product availability, and competing sources.

We do not guarantee any ranking, citation, recommendation, inclusion, traffic level, conversion, revenue, or business outcome. Scores, checks, comparisons, and sampled monitoring are informational estimates and observations, not authoritative statements about every user or every response.

3. Eligibility and merchant responsibility

You must be legally capable of entering into these Terms. If you submit a store or domain for analysis, you represent that you own it or have permission to test it. You remain responsible for your storefront, products, claims, pricing, policies, legal compliance, and any decision made using the Services. Review suggested changes before publishing them.

4. Acceptable use

You may use the Services only for lawful business and evaluation purposes. You must not:

  • scan or submit a system without authorization;
  • interfere with, overload, probe, bypass, reverse engineer, or disrupt the Services;
  • use automated access outside documented interfaces or limits;
  • upload malicious code or attempt to obtain another user’s data;
  • misrepresent Surfaced results as guarantees or official statements from Shopify or an answer-engine provider;
  • use the Services to violate privacy, intellectual-property, consumer-protection, advertising, or other applicable laws.

We may restrict or suspend use that creates security, legal, platform, or operational risk.

5. Third-party platforms and data

The Services may reference or interoperate with Shopify, Cloudflare, OpenAI, Perplexity, Google, and other third-party services. Those providers control their own systems, terms, availability, data, rankings, and outputs. Surfaced is not endorsed by or affiliated with those providers unless expressly stated. We are not responsible for third-party changes, outages, decisions, or use of information shared with them.

6. Accounts, plans, and payments

If Surfaced later offers accounts or paid plans, the checkout page or order form will state the plan, price, billing period, usage limits, renewal terms, cancellation process, and refund policy that apply. No paid subscription is currently created merely by using this content site or scanner preview. Additional terms presented at purchase will form part of these Terms.

7. Customer content and feedback

You retain ownership of store URLs, content, data, and materials you lawfully provide (“Customer Content”). You grant us a limited license to host, process, reproduce, and analyze Customer Content only as needed to provide, secure, improve, and support the Services. You are responsible for having the rights necessary to provide it.

If you voluntarily provide ideas or product feedback, you allow us to use that feedback without restriction or payment, but we will not present private feedback as a public endorsement without permission.

8. Intellectual property

The Services, site design, software, reports, scoring methods, documentation, and Surfaced/SkuWatch branding are owned by us or our licensors and protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use the Services for your internal business purposes. No other rights are granted.

9. Privacy and security

Our Privacy Policy explains how we handle personal information. You must not submit sensitive personal information, payment-card data, health information, passwords, or private customer records unless a future feature expressly supports that data and provides appropriate terms.

10. Service availability and disclaimers

To the maximum extent permitted by law, the Services and content are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and accuracy. We do not warrant that the Services will be uninterrupted, error-free, complete, secure, or compatible with every third-party platform.

Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

11. Limitation of liability

To the maximum extent permitted by law, Surfaced, SkuWatch, and their operators, personnel, suppliers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, goodwill, data, or business opportunities; or decisions made in reliance on scores, content, or third-party outputs.

Our aggregate liability arising from the Services will not exceed the greater of the amount you paid for the Services during the six months before the event giving rise to the claim or US$100. This limitation does not apply where prohibited by law or to liability that cannot legally be limited.

12. Indemnification

To the extent permitted by law, you will defend and indemnify us against third-party claims arising from your Customer Content, your storefront claims, your unauthorized or unlawful use of the Services, or your violation of these Terms or another party’s rights.

13. Suspension and termination

You may stop using the Services at any time. We may suspend or terminate access if we reasonably believe use violates these Terms, creates security or legal risk, harms the Services or another party, or if we discontinue a service. Provisions that by their nature should survive termination will remain effective, including ownership, disclaimers, liability limits, and indemnification.

14. Governing law and disputes

These Terms are governed by the laws applicable where the service operator is legally established, without regard to conflict-of-law rules. Mandatory consumer protections in your place of residence continue to apply where they cannot be waived. Before filing a formal claim, contact us and allow 30 days for an informal resolution.

The governing-law venue and any arbitration or court-selection clause should be finalized when the operating legal entity and principal jurisdiction are confirmed.

15. Changes

We may update these Terms as the Services change. We will revise the effective date and, where required, provide additional notice of material changes. Continued use after revised Terms take effect constitutes acceptance to the extent permitted by law.
